1. General terms and conditions

The following terms and conditions (henceforth: “the terms and conditions”) are valid between you and brand owner of Supermood Oy (business ID: FI25905797) (henceforth: Supermood; may be referred to as “us” and “we”) and apply to all use of and orders placed on Supermood’s website supermood.fi (henceforth: the “website”). Please note that Supermood does not guarantee that all products presented on the website are in stock or are available for purchase. Supermood reserves its right to stop selling a product. Orders can only be placed by persons that are 18 years or older. Supermood reserves the right to revise the terms and conditions at any time. The date of the latest update is found in the final section of the terms and conditions. Users are responsible for keeping themselves updated with such changes. Please note that the terms and conditions valid for your order is always the terms and conditions that is in effect as of the time that you place your order and not a later version. You should keep a copy of these terms and conditions for future reference.

2. Language

The language of the terms and conditions is English.

3. My account

When you place an order on supermood.fi an account will be created in our customer management system. The only information that will be stored is the information you provide to your order such as shipping and billing address as well as email address. If you create an account yourself you will be able to choose a password with which you can log in to your account online and view your order history. If you would like to delete an account you can contact customerservice@supermood.fi and the customer care team will assist you.
To comply with the high security requirements set up by Visa and MasterCard we use a hosted payment service. This means that the actual payment and credit card data is not handled by our server but directly by Paytrail (http://www.paytrail.com), our payment service provider. The hosted payment service we use from Paytrail is fully PCI DSS compliant (payment card industry data security standard). Supermood has no access to your card information and therefore cannot record or store your credit card information.

4. Placing order

By using the website and/or placing an order on the website you confirm that you have read the terms and conditions and the privacy policy, and that you accept them. Please make sure that you have read and understood the terms and conditions before you place an order. Before you place your order, you will be given the opportunity to review your selections, the information you have provided, the total price of your order and correct any input errors. Please note that products in your shopping bag are not reserved and may be purchased by other customers until you have placed the order at checkout and received the order confirmation email. If prolonged inactivity causes your connection to the website to fail, your selection of products may be lost. In such case, you will be required to re-enter your selection of products to the shopping bag.
Supermood website may offer exclusive promotions from time to time. Please find temporary terms and conditions for each offer at the bottom of this page.

5. Order confirmation

After submitting your order, we will send you an order confirmation email with your order number, details of the product you have ordered from us, your payment details and delivery details. Please note that the confirmation email is an acknowledgement that we have received your order and is not an acceptance of the order.

6. Acceptance and shipping confirmation

Please note that all orders placed by you are subject to acceptance by us. We may, at our discretion, choose not to accept your order for any reason whatsoever without any liability to you. Once the order has been processed, a shipping confirmation email will be sent with all relevant information about your order. The shipping confirmation is our acceptance of your order. Please note that Supermood does not guarantee that all products presented on the website are in stock at the time of your order. If a product is unavailable, we will contact you shortly, by email. If we already have received payment for such product we will refund you the amount of the purchase.

7. Colours

Supermood’s goal is to describe the products at the website as correctly as possible. However, please note that due to the colour settings of your computer, the colours of the products shown in the pictures on the website can differ somewhat from their actual colours. Supermood cannot be held responsible for any such discrepancy.

8. Prices

The prices and delivery costs shown on the website include VAT. The prices and delivery costs shown on the website may vary from time to time and Supermood is not bound by the price until Supermood has accepted the order by sending the shipping confirmation to you. The prices may also vary between a physical store and the website. If you have placed an order and the price has changed before we have accepted your order (by sending you the shipping confirmation), we will notify you by email about the price change and give you the option to place a new order with the new price or cancel the old order. If we are unable to contact you, your order will be cancelled. Supermood always reserves the right to cancel any order prior to our acceptance of the order. If we already have received payment for a cancelled order we will refund you the amount of the purchase. Please also note that Supermood may cancel the order even if it has been accepted by Supermood under the condition that you realize or should have realized that the price information was incorrect. The delivery costs are shown in connection with the shipping methods at the checkout stage.

9. Payments

Payment service provider

Paytrail Oyj (2122839-7) acts as an implementer of the payment handling service and as a Payment Service Provider. Paytrail Oyj will be shown as the recipient in the invoice and Paytrail Oyj will forward the payment to the merchant. Paytrail Oyj is an authorized Payment Institution. For reclamations, please contact the website you made your payment to.

Payment by card

Payments by Visa, Visa Electron, MasterCard, Diners Club, JCB and American Express
Payment service is provided by Paytrail Oyj in cooperation with Finnish banks and credit institutions. In payments made by Visa, Visa Electron or MasterCard Paytrail appears on the card invoice as receiver of payment and will transfer the payment to the merchant. Paytrail has a payment institution license.

Card payments are made through secure SSL-encrypted payment form from which the data is forwarded encrypted to the credit company. None of the card information is stored in the system. When paid with online bank credentials the customer is directed to Finnish online banking payment services where the transactions are registered safely in each bank’s own payment system.

Online bank payment (Finland only)

Paytrail Oyj (FI2122839) provides netbank related payment transfer services in co-operation with Finnish banks and credit institutions. For consumer, the service works exactly the same way as traditional web payments.
Pay your order securely with Nordea, Osuuspankki, Danske Bank, Ålandsbanken, Handelsbanken, S-Pankki, Aktia, Säästöpankki, POP Pankki and Oma Säästöpankki online banking credentials.

PayPal

PayPal is the safer, easier way to pay online. Pay with your credit card without exposing your credit card number to the merchant. Plus, speed through checkout whenever you shop online. When you place an order with PayPal you will be redirected to the PayPal website. There you will then need to login with your PayPal username and password. Before completing the order, check whether the total amount and billing details are correct. Even if you are not an existing PayPal customer, you can choose this payment method for today’s purchase and either set up a new account or pay as a guest. If your order consists of multiple deliveries, your PayPal account will be charged separately for each shipment.

Collector invoice and instalment (available only in Finland):

By selecting Collector invoice and instalment as your payment method you will receive all items before paying for them. You can pay the bill either all at once or you can divide it into instalments. Due date for the bill is the last day of the following month, so you will have up to 60 days of payment time. Collector will add 2.95 EUR billing fee. If you wish to pay in instalments an interest rate of 1.6% per month and 2.95 EUR billing fee will be added per month. Annual interest rate is 19.20%. Persons who wish to use Collector invoice or instalment must be 20 years of age and can only order to their permanent address. Collector always checks credit score before the bill is approved. For late payments and unpaid bills, a reminder fee of 5 € is charged as well as a monthly interest of 1,6% for the period that the payment is late. You can use Collector invoice and instalment to pay purchases of max. 1000 EUR. The credit grantor is Collector Credit AB (corporate registration number 556597-0513), in cooperation with Collector Oy.

12. Resale policy

You may purchase products on supermood.fi for personal use only and not for resale. By placing an order on supermood.fi, you certify that you are purchasing products for your own personal use and not for resale and that you accept the terms and conditions. We reserve the right to refuse orders for any reason without explanation.

13. Information on the website

Supermood cannot promise that the content of the site is free of inaccuracies or typographical errors. Neither can we guarantee that all information is up-to-date. Supermood may, at any time, amend the content of the site. Although Supermood strives to display the correct texts, images and pricing on the site and online shop, errors may occur. Part of the services provided through the site are maintained by third party operators. In situations where Supermood acts as agent for such services, we cannot be held responsible for any errors resulting from their activities. Supermood cannot be held responsible for any damage caused from using the site or, for that matter, not being able to use the site. Supermood cannot guarantee problem-free, uninterrupted, and secure access to the site.

The website may contain links to other websites beyond our reach. We cannot be held liable for content or privacy policies of such sites.

15. Violation of rules

Supermood reserves the right to seek all solutions available at law and in equity for violations of these terms and conditions, including the right to block access to the site. Individuals violating the restriction of password-protected areas of the site may be subject to prosecution.

16. Supermood responsibility

Supermood’s liabilities to you are limited in each separate case to these terms and conditions unless otherwise is stipulated by law. In no case, whatsoever will Supermood assume any liability for indirect damages such as loss of profit or in case of force majeure such as war, civil war, revolution, riot, governmental measures, strike, lockout, blockage, failure of electricity, telephone or internet service, natural disasters or similar events. Supermood’s liabilities to you will never exceed your total purchase amount for each order. In case of force majeure, Supermood’s obligations will be suspended. The contract between you and Supermood can, in such cases, be partially or fully terminated by yourself or by Supermood.

17. Provisions severability

If any part of these terms and conditions are held to be invalid or unenforceable, such determination shall not invalidate any other provision of these terms and conditions; instead the invalid terms and conditions shall be replaced with other terms in order to give effect to the commercial intentions of these terms and conditions.

18. Governing law

These terms and conditions are governed by the laws of Finland (excluding the international sale of goods act). Any disputes pertaining to these terms and conditions will be exclusively referred to the district court of Helsinki, as the court of first instance. Please note that you can also file possible claims against Supermood before the national board for consumer disputes (arn).

20. Version of the terms and conditions

If there is any conflict, ambiguity, or discrepancy between the English version and a version in another language, this version shall always prevail. The latest update of the terms and conditions of Supermood was made in June 2017.
